Cretantour – Tours & Excursions on Crete

1. Scope

1.1. These Terms and Conditions (T&C) apply to all contracts, bookings, and services concluded between the customer (hereinafter “Customer”) and the company Cretantour, owned by Ioannis Trachanas (hereinafter “Cretantour” or “Provider”).

1.2. The scope includes guided tours, day trips, experiences, and third-party services on the island of Crete (Greece).

1.3. These T&C apply to own services as well as services provided by third parties.

1.4. Divergent or conflicting terms of the Customer shall only be effective if explicitly accepted in writing by Cretantour.

3. Contract Language

The contract language is German. Translations into other languages serve for information purposes only. In case of discrepancies, only the German version is binding.

4. Subject Matter of the Contract

4.1. Cretantour offers bookings of tours, excursions, boat trips, cultural journeys, hikes, and other tourist services on Crete.

4.2. For services provided by third parties (e.g. local boat trips, guided tours, etc.), the respective third party is the contracting partner. Cretantour acts solely as an intermediary.

4.3. The exact service description can be found on the website offer page and in the booking confirmation.

5. Conclusion of Contract and Booking

5.1. The presentation of offers on the website does not constitute a binding promise but serves to submit a booking inquiry by the Customer.

5.2. By submitting the booking inquiry, the Customer does not make a binding offer but merely an unverbindliche Anfrage (non-binding request) to book.

5.3. The contract is concluded upon written booking confirmation by Cretantour.

5.4. For mediated services, Cretantour acts exclusively as an intermediary. The contract is concluded directly between the Customer and the respective third party.

6. Prices and Payment Terms

6.1. All prices include statutory VAT.

6.2. Payments can be made by prepayment, credit card, PayPal, instant transfer, or cash on site, depending on the chosen payment method.

6.3. For third-party services, payment may also be made directly to the third party.

6.4. The total amount is due, unless otherwise agreed, before the start of the tour.

6.5. For last-minute bookings (<3 working days before the start of the tour), payment by direct transfer is required.

6.6. If payment is not made on time, Cretantour may cancel the booking.

7. Gift Vouchers

7.1. Cretantour offers value gift vouchers and tour-related vouchers that are valid exclusively for services bookable via Cretantour.

7.2. Vouchers are non-redeemable for cash and non-transferable.

7.3. Validity is 1 year from the date of issue, unless otherwise stated.

7.4. Redemption takes place on site upon presentation of the voucher.

7.5. If the voucher is not redeemed within the validity period, it expires without further claims.

7.6. Partially redeemed vouchers remain valid as credit; if the price is higher, the difference must be paid.

7.7. Cretantour assumes no liability for loss, theft, or misuse of vouchers.

7.8. Vouchers cannot be combined with other discount promotions unless otherwise stated.

8. Participation Conditions and Duties to Cooperate

8.1. By booking, the Customer confirms that no health impairments exist that could endanger safe participation in the tour.

8.2. Pregnant women, parents with small children, and persons with health risks participate at their own risk.

8.3. Known allergies, health impairments, or special needs must be communicated to Cretantour prior to the tour.

8.4. Violations of cooperation duties (e.g., nondisclosure of health risks) exclude liability of Cretantour for resulting damages or injuries.

8.5. All participants must follow the instructions of the staff and guides.

8.6. Late arrival without timely notification or no-show at the meeting point leads to exclusion from the tour without refund.

8.7. The Customer is obliged to report recognizable defects or complaints immediately, at the latest during or immediately after the tour, to the tour guide or Cretantour. Failure to timely report excludes claims for remedy, reduction, or damages.

9. Cancellation and Rebooking by the Customer

9.1. Cancellations must be made in writing (email).

9.2. Free cancellation is possible up to 24 hours before the start of the tour; afterwards, no refund is granted.

9.3. Rebookings are possible free of charge up to 24 hours before the tour, subject to availability and agreement; price differences apply.

9.4. Refunds will be made via the original payment method.

10. Changes and Cancellations by the Provider

10.1. Cretantour may change, postpone, or cancel tours for important reasons, especially safety concerns, weather, natural events, illness of guides, or technical problems.

10.2. In such cases, Cretantour will endeavor to offer an alternative date or refund the already paid amount.

10.3. Cretantour is not liable for consequential costs such as flights, hotels, or other expenses incurred by the Customer due to changes or cancellations.

10.4. Further claims for damages are excluded except in cases of intent or gross negligence by Cretantour.

11. Liability and Insurance

11.1. Participation in tours is at the Customer’s own risk.

11.2. Cretantour is liable only in cases of intent and gross negligence.

11.3. In cases of ordinary negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations) and limited to foreseeable damage.

11.4. Cretantour is not liable for damages caused by the Customer’s breach of cooperation duties (e.g., health information).

11.5. For mediated services, the respective third parties are liable

11.6. Cretantour assumes no liability for loss, theft, or damage to personal belongings.

11.7. Customers are responsible for adequate insurance coverage (e.g., accident, trip cancellation, travel health insurance) during their holiday.

11.8. Liability of Cretantour for personal injury including death is excluded unless intent or gross negligence exists. Especially, Cretantour is not liable for health damages resulting from non- compliance with participation conditions or incorrect information provided by the Customer.

11.9. Cretantour assumes no liability for the performance or non-performance of services by third parties.

12. Conduct During the Tour

12.1. Customers must follow the instructions of guides and staff.

12.2. Customers exhibiting behavior endangering safety or grossly disregarding rules may be excluded from the tour without refund.

12.3. Health complaints must be reported immediately to staff. 12.4. Unused services will not be refunded.

13. Photo and Video Recordings

13.1. During tours, photos and videos may be taken by Cretantour staff.

13.2. Participation constitutes consent to unrestricted use of recordings for advertising and marketing purposes (website, social media, print).

13.3. Objections to publication can be submitted in writing before or during the tour.

14. Data Protection and Data Security

14.1. The collection, processing, and use of personal data complies with the EU General Data Protection Regulation (GDPR) and Greek data protection law.

14.2. Personal data is used solely for the purpose of executing and processing booked services.

14.3. Personal data will only be shared if necessary for contract fulfillment (e.g., local service providers).

14.4. Cretantour implements technical and organizational measures to protect data from unauthorized access, loss, or misuse.

15. Notice on Third-Party Terms and Conditions

15.1. The general terms and conditions of the respective third parties apply additionally to all mediated services.

15.2. These T&C are also binding for the Customer and accepted upon booking.

15.3. Cretantour assumes no liability for the fulfillment of third-party services.

16. Force Majeure

16.1. Cretantour is not liable for events of force majeure (e.g., natural disasters, strikes, pandemics, governmental measures).

16.2. Services may be postponed or canceled in such cases.

16.3. The Customer will be offered alternative dates or refunds; further claims are excluded.

17. Jurisdiction and Applicable Law

17.1. The law of the Hellenic Republic (Greece) applies.

17.2. Jurisdiction for disputes is Heraklion, Crete.

17.3. For consumers residing outside Greece, mandatory consumer protection laws of their country apply.

17.4. The European Commission provides an online dispute resolution platform (ODR) accessible at https://ec.europa.eu/consumers/odr. We value customer satisfaction and are available for questions or complaints personally. Currently, participation in consumer arbitration procedures is not mandatory.

18. Severability Clause

Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected. The invalid clause will be replaced by a provision that comes as close as possible to the economic purpose.

19. Right of Withdrawal

Withdrawal information pursuant to Art. 246 § 2 para. 1 no. 12 EGBGB in conjunction with § 312g para. 2 no. 9 BGB:

The right of withdrawal does not apply to contracts for the provision of services in the area of leisure activities if the contract provides for the performance on a specific date or within a specific

period. As the tours, excursions, and experiences offered by Cretantour are services rendered at a defined time, no right of withdrawal exists. Cancellation is only possible according to Section 9 of these T&C.

20. Amendments to the Terms and Conditions

Cretantour reserves the right to change these terms and conditions at any time. For each booking, the terms valid and published on the website at the time of booking apply. Customers are requested to check the current terms before each booking.
